USCIS has implemented a new policy regarding how applications will be processed for applications filed on or after September 12, 2018. Under the new policy, any application that is submitted without all required initial evidence or, from the evidence submitted, that does not prove that the applicant is eligible for the benefit sought can be denied without requesting the necessary, additional evidence from the applicant.
Under the previous policy, USCIS would issue a Request for Evidence prior to denying the application to give the applicant an opportunity to file the necessary, additional evidence before making the decision to approve or deny the application.
Note: This new policy does not apply to Asylum or DACA applicants.
Los Servicios De Ciudadanía e Immigracion De Los Estados Unidos han implementado una nueva política con respecto a cómo se procesarán las solicitudes para las solicitudes presentadas a partir del 12 de Septiembre,2018. Bajo la nueva política cualquier solicitud que se presente sin todas las pruebas iniciales requeridas o, a partir de la evidencia presentada, que no demuestre que la solicitud es elegible para el beneficio buscado, puede negarse sin solicitar la evidencia adicional necesaria del solicitante. Bajo la política anterior, Los Servicios De Ciudadanía e Immigracion De Los Estados Unidos emitió una solicitud de evidencia antes de denegar la solicitud para darle al solicitante la oportunidad de presentar la evidencia adicional necesaria antes de tomar la decisión de aprobar o denegar la aplicación.
